These Terms of Service (“Terms”) govern the use of the website, platform, and services (collectively, the “Platform”) operated by Consult Fox UG (haftungsbeschränkt)

By accessing or using the Platform, you agree to be legally bound by these Terms.

1. Age Restriction & Eligibility

Alcohol may only be purchased by persons who are legally permitted under German law.
In accordance with the German Youth Protection Act (Jugendschutzgesetz):
- Beer and wine: Minimum age 16
- Spirits and spirit-based beverages: Minimum age 18
By placing an order, you confirm that:
- You meet the legal age requirement.
- All information provided is accurate.
We use age verification procedures both online and at delivery.

Consult Fox UG reserves the right to cancel orders if age verification fails.

2. Compliance with German & EU Law

Alcohol sales are subject to German and EU regulations.
We only deliver to regions where alcohol delivery is legally permitted.
The customer is responsible for ensuring that receipt of alcohol at the delivery address is lawful.
Title and risk transfer upon delivery, in accordance with § 446 BGB.

3. Account Registration

Users may be required to create an account.
You are responsible for safeguarding login credentials.
False age or identity information constitutes a material breach of contract.
We reserve the right to suspend or terminate accounts for:
- Fraud
- Chargeback abuse
- Age misrepresentation
- Violation of law

4. Orders & Contract Formation

Product listings constitute a non-binding invitation to order.
A binding contract is formed only upon:
- Explicit order confirmation via email.
We reserve the right to refuse orders without stating reasons.
Prices include VAT unless otherwise stated.
Shipping costs are displayed separately before checkout.

5. Delivery & Age Verification

Delivery is made only to:
- The ordering customer, or
- Another person of legal age at the delivery address.
Valid government-issued ID may be required.
We will not:
- Leave alcohol unattended.
- Deliver to visibly intoxicated individuals.
Failed deliveries due to age verification refusal may incur additional delivery costs.

6. Right of Withdrawal (Widerrufsrecht)

Consumers have a statutory right of withdrawal under EU distance selling law.

However, withdrawal may be excluded if:

The product is unsealed after delivery, and
The goods are not suitable for return due to health protection or hygiene reasons.

7. Returns & Refunds

Returns are accepted only in cases of:
- Damaged goods
- Incorrect delivery
- Defective products
Claims must be reported within 48 hours of receipt.
Refunds will be processed to the original payment method.

8. Responsible Consumption

Consult Fox UG promotes responsible alcohol consumption.

Customers agree:

Not to purchase alcohol for minors.
Not to resell alcohol without appropriate licensing.
Not to use products unlawfully.

We disclaim liability for misuse of alcohol after delivery.

9. Limitation of Liability

To the extent permitted under German law:

We are fully liable for:
- Intentional misconduct
- Gross negligence
- Injury to life, body, or health
For slight negligence, liability is limited to foreseeable damages typical of the contract.
